2019 Pioneer Maize Early Order Full Terms & Conditions

  1. The promoter is Genetic Technologies Limited (“GTL”), 1 Banks Street, Gisborne. Participation in this promotion is subject to the acceptance of these terms and conditions.
  2. The Opening Date for the Early Order Benefits promotion is 8am on 1 May 2019 and the Closing Date is 4pm on 31 July 2019 (“Closing Date”).
  3. Growers must place an official and binding/firm order for Pioneer® brand hybrid maize seed that is in stock with a participating merchant, which must be placed with GTL prior to the Closing Date to be eligible for this offer. Orders for Forage King are not eligible for this offer.
  4. The offer is open to growers who place and transact their order with a participating merchant.
  5. The offer is not transferable.
  6. GTL’s decision in respect of any dispute, or the interpretation of these terms and conditions is final and no correspondence will be entered with any grower or third party.
  7. GTL’s and the participating merchants’ normal conditions of sale/terms of trade also apply between the merchant and the grower.
  8. Except as expressly stated in these terms and conditions and except for any liability that cannot be excluded by law, GTL and its participating merchants exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the 2019 Pioneer Maize Early Order Benefits Promotion.
  9. GTL reserves the right to change any aspect of this promotion at any time without notice.
  10. All personal information collected will be held by GTL at 1 Banks Street, Gisborne. Under the Privacy Act 1993, growers have the right to access and correct any such personal information. Growers may correct any of the details about them by sending an email to service@genetic.co.nz.

    Vest Terms & Conditions

  11. Subject to condition [3] above, growers will receive one Stoney Creek Boiler Vest, limited to one per account, delivered in September/October 2019.

    Preferential Hybrid Supply Terms & Conditions

  12. If a completed merchant order form has been received at GTL’s Gisborne Seed Production Office by the Closing Date for Pioneer® brand hybrid maize seed that is then in stockthe seed will be allocated on a first–in, first-served basis based on the date on which the Pioneer® brand hybrid maize seed was ordered until each maize hybrid seed stock is exhausted.

    100% Seed Replant Benefit Terms & Conditions

  13. Subject to the conditions below, if:

    a)      a grower has ordered Pioneer® brand hybrid maize seed before 4pm, 31 July 2019 in accordance with these terms and conditions,

    b)      the grower has planted that Pioneer® brand hybrid maize seed during Spring 2019,

    c)       within two months of the date of planting, the grower notifies GTL that their Pioneer® brand hybrid maize crop needs replanting,

    d)      the affected area is assessed as requiring replanting by a Pioneer representative, and

    e)      the grower replants Pioneer® brand hybrid maize seed for harvesting in 2020 and the replanting is be approved by a Pioneer representative,

    GTL will provide full replacement seed at no cost for the affected Pioneer® brand hybrid maize seed for the grower to replant.

  14. Subject to meeting condition [13] above, as a contribution towards a grower’s other costs associated with replanting, GTL will contribute $100 per bag (plus GST) for each bag of Pioneer® brand hybrid maize seed supplied for replanting. This will be provided in the form of a direct credit into a grower’s nominated bank account. The grower will need to provide bank account details and a GST registration number for direct credit processing and preparation of a Buyer Created Tax invoice for tax purposes.
  15. This benefit only applies to Pioneer® brand hybrid maize seed which is planted in accordance with Pioneer® brand products’ specifications and recommended crop establishment practices set out on the Pioneer® brand hybrid maize seed bags and in the technical insights section of the Pioneer website.
  16. This benefit does not apply to Pioneer® brand hybrid maize seed treated by a third party. 

    Harvest Protection Benefit Terms & Conditions

  17. Subject to the conditions below, if:

    a)      a grower has ordered Pioneer® brand hybrid maize seed before 4pm 31 July 2019 in accordance with these terms and conditions,

    b)      the grower has planted that Pioneer® brand hybrid maize seed during Spring 2019, and

    c)       an area of the grower’s Pioneer® brand hybrid maize crop is Unharvestable as defined in condition [19]; GTL will provide, at no cost, the amount of replacement seed required (as assessed by a Pioneer representative) to replant the Unharvestable Area for the Spring 2020 planting season.  

  18. To be eligible for the Harvest Protection Benefit, the seed ordered must be treated with LumiGEN L-200, LumiGEN L-200+, LumiGEN L-300, LumiGEN L-300+, LumiGEN L-400 or LumiGEN L-400+ treatments. Seed not treated with these seed treatments or treated by a third party are not eligible for this benefit.
  19. Unharvestable means where a Pioneer® brand hybrid maize crop is planted and that maize crop is not able to be harvested due to factors outside of the growers’ control. These factors include but are not limited to wind; hail; flooding; frost and drought. An Unharvestable Area means an area within a paddock or of continuous cropping land, not separated by fences, races, or other natural or geographic barriers, that is unharvestable. An Unharvestable Area does not include areas partly Unharvestable and only applies to areas which are 100% Unharvestable. The affected area must be assessed and approved as an Unharvestable Area by a Pioneer representative.
  20. Subject to meeting condition [16] above, as a contribution towards a grower’s other costs associated with planting the equivalent unharvestable area, GTL will contribute $100 (plus GST) for each bag of Pioneer® brand hybrid maize seed supplied for replanting. This will be provided in the form of a direct credit into a grower’s nominated bank account in 31 August 2020. The grower will need to provide bank account details and a GST registration number for direct credit processing and preparation of a Buyer Created Tax invoice for tax purposes.
  21. This benefit is available for Autumn 2020 harvest only.
  22. This benefit only applies to Pioneer® brand hybrid maize seed which is planted in accordance with Pioneer® brand products’ specifications and recommended crop establishment practices set out on the Pioneer® brand hybrid maize seed bags and in the technical insights section of the Pioneer website.
  23. GTL must be made aware of all Unharvestable Areas before 31st May 2020 for maize silage crops and 30th June 2020 for maize grain crops.
  24. This cover does not apply to Pioneer® brand hybrid maize seed treated by a third party. 
  25. GTL will cover eligible Unharvestable Areas up to an annual national maximum area of 1000 hectares. If in the unlikely case that national claims exceed 1000 hectares, GTL will collate all eligible claims and the claimants will be provided with a proportional amount of replacement seed bags and $100 per bag of Pioneer® brand hybrid maize seed supplied for replanting cash payment calculated, based on the area of their eligible claim, as a proportion of the total claims to the maximum annual crop loss of 1000 ha.
  26. GTL’s decision in respect of any dispute, or the interpretation of these terms and conditions, including the 100% Seed Replant Benefit Terms and Conditions and the Harvest Protection Benefit Terms and Conditions, is final and no correspondence will be entered with any grower or third party.
